Agreement to Terms

By accessing or using nowpublic, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

About Us

nowpublic is a product of Simpllyf Software, registered in British Columbia, Canada.

Description of Service

nowpublic provides a tunneling service that exposes your local development servers to the internet via secure URLs. We route traffic through our edge network to your local machine.

nowpublic is an independent service and is not affiliated with, endorsed by, or sponsored by GitHub, Inc. or Cloudflare, Inc.

Preview Service

Certain features or the service as a whole may be designated as "preview", "beta", or "early access". Such features are provided for evaluation purposes and may be modified, discontinued, or experience interruptions without notice. We make no guarantees regarding the availability, reliability, or performance of preview features. Your use of preview features is at your own discretion and risk.

Your Responsibilities

You agree that:

• You are responsible for all content exposed through your tunnels
• You will not use the service for illegal purposes
• You will not attempt to circumvent usage limits or abuse the service
• You will not use the service to host production workloads (this is a development tool)

Acceptable Use

You agree not to use nowpublic to:

• Distribute malware or malicious software
• Host phishing pages or conduct fraud
• Distribute illegal content
• Infringe on intellectual property rights
• Distribute credentials, API keys, or other sensitive authentication material
• Attempt to gain unauthorized access to our systems or other users
• Conduct attacks (DDoS, spam, port scanning) through our infrastructure

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Free tier tunnels have rate limits and may be terminated at our discretion. We may modify or discontinue the service at any time with reasonable notice.

Pricing and Payments

Free tier includes limited bandwidth and request limits. Pro tier ($5/month) includes higher limits and additional features. Pricing is subject to change with notice.

Termination

We may terminate or suspend your account at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to, violations of these terms or abuse of the service.

You may cancel your account at any time by deleting your account from the dashboard.

Indemnification

You agree to indemnify, defend, and hold harmless nowpublic, Simpllyf Software, and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the service or your violation of these terms.

Reporting Abuse

If you believe content exposed through nowpublic violates our acceptable use policy or applicable law, please contact us at hi@nowpublic.dev with details. We will investigate and take appropriate action, which may include terminating the offending tunnel.

Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, nowpublic and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.

In no event shall our total liability to you for all claims arising from or related to the service exceed the amount you paid us, if any, during the twelve (12) months preceding the claim.

Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms.

Governing Law

These terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions.
